Texas Flip Puts Casino Legislation Back on the Table

Shift in Texas Leadership

Vikki Goodwin assumed the role of Lieutenant Governor in Texas, replacing Republican Dan Patrick following the recent midterm elections. This change in leadership marks the first time the position has been held by a Democrat in several decades. The shift is significant for the gambling industry because Patrick had previously indicated he might support legalizing sports betting and land-based casinos only if it became the overwhelming consensus of the Republican-controlled state senate. In 2026, Patrick also sought mechanisms to prevent prediction markets from operating within the state.

Goodwin, by contrast, has supported the broader expansion of commercial casinos and online sports betting, specifically through voter referendums. This difference in political stance suggests that the political calculus for gambling legalization in Texas may change as the new administration takes shape.

Ohio and Georgia Move Toward Expansion

In Ohio, Democrat Amy Acton won the governor’s race, taking over from Republican Mike DeWine, who was term-limited after two terms. DeWine is credited with opening Ohio’s online sports betting market during his tenure. Acton has stated she wants to expand the gambling industry to generate revenue for schools, childcare, and property tax relief. The estimated iGaming revenue in Ohio at maturity is projected to be $2.9bn, a figure that underscores the financial potential of the sector for state budgets.

Georgia experienced a similar shift as Keisha Lance Bottoms won the governor’s race. Currently, the lottery is the only form of legal gambling in the state. Bottoms campaigned on a policy to legalize casino gambling, a plan that would require a ballot referendum to become reality. However, she has not expressed a specific position on online sports betting, leaving that aspect of the market undefined in her immediate policy agenda.

Ballot Measures in Virginia and Nebraska

In Virginia, voters were asked to permit pari-mutuel wagering at satellite facilities in Amherst County and Pulaski. The measure failed to pass in Pulaski. In Amherst County, the result was too close to call, leaning in favor of the measure by a majority of only three votes. The narrow margin highlights the contentious nature of local gambling expansions in the state.

Nebraska voters rejected Initiative measures 440 and 441, which would have legalized and regulated online sports bets. According to election results, 54% of Nebraska voters said no to the measures. This rejection represents a significant setback for operators seeking to enter the Nebraska market through legislative or regulatory channels.

Indiana and Machine Allocation

In Indiana, voters in Allen, DeKalb, and Steuben County voted separately on a potential $500m casino project. The project was rejected in all three counties. Earlier in February, House Bill 1038 was passed, which left the final decision on casino development to local voters. The rejection in these key counties suggests that despite the legislative framework, local opposition remains a barrier to large-scale casino development in the state.

Meanwhile, Churchill Downs is operating near its state limit of 5,000 machines. Jordan Bender, associated with the company, noted that if certain conditions are met, the company expects to relocate units from locations impacted by new casino supply and competition. “If passed, we would expect the company to relocate units from locations that have been impacted by new casino supply and competition, and add units to hit the remaining under the 5K allocation in those less-competitive markets with better access across the border in North Carolina, such as Winston-Salem (90 miles from Pulaski),” Bender said. This strategy indicates a potential shift in machine placement toward markets with less direct competition from new casino entrants.

Why It Matters

The election of Democratic governors in Texas, Ohio, and Georgia creates a more favorable political environment for gambling expansion, potentially unlocking new revenue streams for state budgets. For operators, the shift in Texas leadership removes a key obstacle to casino and sports betting legislation, while the rejections in Nebraska and Indiana highlight the persistent challenges of local ballot measures. Regulators and investors must now monitor how these new administrators navigate the legislative process to implement their gambling agendas.
